1. Acceptance of Agreement

By creating an account, accessing, or using ZippyGo ('Platform'), you agree to be legally bound by this Agreement. You must be at least 18 years old to create an account or book travel. If you do not agree, you must not use the Platform.

2. Nature of Service – Ticket Agent Status

ZippyGo operates solely as a ticket agent and intermediary facilitating airline bookings. ZippyGo is not an air carrier and does not operate aircraft. Air transportation is governed by the airline's contract of carriage. Airlines are solely responsible for flight operations, schedule changes, delays, cancellations, baggage handling, and onboard services.

3. Regulatory Compliance

Refund rights and airline obligations are governed by applicable U.S. federal aviation regulations. Where required by federal law, refunds will be processed in accordance with mandated timelines. Nothing in this Agreement limits rights that cannot be waived under federal law.

4. Platform Service Fee (Digital Facilitation Fee)

The Platform Service Fee compensates digital infrastructure, AI/LLM processing, hosting, fraud prevention, engineering maintenance, and booking facilitation services rendered at the time of transaction. This fee is separate from airfare, government taxes, and carrier-imposed charges. The fee is fully earned upon booking confirmation. In voluntary cancellations, this fee is non-refundable. In airline-initiated cancellations or significant changes, refunds will be processed in compliance with applicable federal law.

5. Payment Processing Fee

Payment processing fees represent third-party transaction costs incurred at the time of payment. These fees are separate from airfare and are not remitted to airlines. To the extent required by applicable federal law, refunds will be processed accordingly.

6. Cancellation & Refund Rights

Airline-initiated cancellations or significant schedule changes entitle passengers to refunds in accordance with federal regulations. Voluntary cancellations are governed by airline fare rules displayed at booking. Refund timelines for credit card purchases are typically processed within 7 business days after eligibility confirmation; other payment methods may take up to 20 calendar days, subject to regulatory requirements.

7. Limitation of Liability

To the maximum extent permitted by law, ZippyGo shall not be liable for indirect, incidental, consequential, punitive, or special damages including loss of profits, emotional distress, missed connections, or business interruption. Total liability shall not exceed the total amount paid for the affected booking.

8. Federal Preemption

Claims relating to airline pricing, routes, or services may be preempted by federal law under the Airline Deregulation Act. Nothing in this Agreement expands rights beyond those permitted under federal aviation law.

9. Arbitration & Class Action Waiver

All disputes shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in New Jersey unless otherwise required by law. You waive the right to participate in class actions or jury trials. You may opt out of arbitration within 30 days of account creation by providing written notice.

10. Force Majeure

ZippyGo shall not be liable for failures or delays caused by events beyond reasonable control including weather, natural disasters, public health emergencies, war, terrorism, labor disputes, government actions, cyberattacks, infrastructure failures, or airline operational decisions.

11. Fraud & Chargeback Abuse

Fraudulent chargebacks, false refund claims, or abuse of cancellation policies may result in account suspension, booking cancellation, recovery actions, and reporting to relevant authorities.

12. Data Collection and Storage

We collect the following personal data: account information (name, email) via Google or Apple Sign-In; passenger details (full name, date of birth, gender, email, phone number) entered for flight bookings; device identifiers for session management; voice audio when using the voice assistant feature; and booking history and payment confirmation data.

All data is encrypted in transit (TLS/HTTPS) and stored in encrypted databases on secure cloud infrastructure located in the United States. Your data is stored securely for future booking convenience and is not shared with any third-party AI service for model training. We retain your data only as long as necessary to provide our services and comply with legal obligations. We do not sell personal data for advertising purposes. Residents of certain states may request access or deletion of personal information subject to verification. In the event of a data breach, affected users will be notified in accordance with applicable law.

13. Third-Party Data Sharing

We share your data with third-party service providers solely to provide our booking and voice assistant features:

  • AI & Voice Processing Providers — Convert your voice to text, interpret your travel requests using AI, and generate spoken responses to help you search for and complete bookings. These providers receive your voice audio, the text of your requests, and the passenger details you provide for a booking (such as name, date of birth, contact details, and passport information when required). They do not receive your payment card details.
  • Real-Time Communication Provider — Enables real-time audio communication between your device and our voice assistant. Receives your voice audio stream and connection metadata (device identifier, user identifier).
  • Airline Booking Provider — Processes airline bookings. Receives passenger details (full name, date of birth, gender, email, phone number) required to create reservations.
  • Payment Processor — Processes payments. Receives your payment information and email address.
  • Authentication Provider — Provides secure sign-in services. Receives your email and display name.

We do not sell personal data for advertising purposes. We do not use your data to train AI models. Each third-party provider is contractually required to protect your data in accordance with applicable law and to provide the same or equal level of protection as described in this policy.

14. Voice Data Processing

When you use ZippyGo's voice assistant:

  1. Your voice is captured by your device's microphone.
  2. Audio is transmitted in real-time to our voice processing providers.
  3. Your speech is converted to text.
  4. Your request is interpreted using AI to understand your flight request.
  5. A response is generated and spoken back to you.

Voice audio is processed in real-time and is not permanently stored by ZippyGo or its providers after processing. Your data is not used by any third-party AI service for model training. You provide explicit consent to this processing before sign-in, and you may withdraw it at any time by revoking microphone permission in your device settings or by discontinuing use of the voice assistant.

15. Governing Law

This Agreement is governed by the laws of the State of New Jersey, subject to applicable federal aviation regulations.

16. Severability & Survival

If any provision is deemed unenforceable, the remaining provisions shall remain in full force. Provisions relating to arbitration, limitation of liability, indemnification, and governing law survive termination.

17. Indemnification

You agree to indemnify and hold harmless ZippyGo, its affiliates, officers, and partners from claims arising from misuse of the Platform, violation of law, or breach of this Agreement.
